We asked you whether we may use a photo/video of you for one or more nebenan.de communication channels. Thank you for taking the time to answer our questions! At this point, we would like to inform you about your rights regarding the use of photos/videos by us. The following information does NOT apply to photos/videos that users have uploaded to nebenan.de via their private profile (exception: you have explicitly agreed to the use of your profile picture upon request). The following information applies exclusively to photos/videos of users who were directly contacted and requested by the nebenan.de communications team.

General Information on Copyright

Your copyright and your right to your own image are taken very seriously by nebenan.de, represented by Good Hood GmbH. Therefore, we have summarized the legal information for you that accompanies the submission of your photo or video to us.

By uploading (within the questionnaire for usage) or sending (by email to your contact person at nebenan.de):

• you grant us the non-exclusive usage rights to the provided photo/video. This means that you can also share the photo/video with other persons or companies without consulting us.
• you agree that the photo/video you provide may be used by Good Hood GmbH without limitation in time, space, subject matter, and content for the purposes you have specified. For this purpose, we also store your photo/video.
• you confirm that you are the sole holder of all unrestricted rights to the provided photo/video and are therefore authorized to grant us as licensee (Good Hood GmbH) the contractual usage rights.
• you agree that you will not receive any payment for the publication.
• you can rely on the fact that we will not make any changes to the photo/video that alter the original depiction in such a way that it causes you personal disadvantages. We also do not make changes that are restricted by other rights (e.g., personality rights, trademark rights).
• By sending or uploading your photo/video to us, Good Hood GmbH, you consent to the processing of your personal data in accordance with Art. 13 GDPR. Full information can be found at https://nebenan.de/privacy

Right to One's Own Image / Right to Object

If you or other persons are depicted in the image, the right to object applies to the depicted persons — for example, you or your neighbors. This means that the depicted persons can contact us at any time and ask us to remove the respective photo/video from our communication channels, such as the nebenan Magazine.

I have been explicitly informed about my rights to my own image and about the content of Art. 21 (Right to Object) of the General Data Protection Regulation, especially paragraphs 1-3:
“(1) The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on Article 6(1)(e) or (f), including profiling based on those provisions. The controller shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.
(2) Where personal data are processed for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing.
(3) Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.

I am aware that photos/videos on the internet can be accessed by any persons. Despite all technical precautions, it cannot be ruled out that such persons may reuse the photos/videos or pass them on to others.
